This page sets out the terms, policies, and legal notices that apply to the use of BoatByDay (“BoatByDay”, “we”, “us”, “our”). By accessing or using this website (the “Platform”), you agree to these terms. If you do not agree, do not use the Platform.

Notice: BoatByDay is a discovery directory. We do not operate vessels, employ skippers, take bookings, collect payments for cruises, or act as an agent for travelers or operators.

2. What BoatByDay Does (and Does Not Do)

BoatByDay helps travelers discover private day-cruise operators and contact them directly.

BoatByDay does not:

handle or confirm bookings or reservations
process cruise payments between travelers and operators
set operator pricing, availability, inclusions, or policies
guarantee enquiry volume, booking outcomes, response time, or service quality
verify licensing, insurance, certifications, or regulatory compliance unless explicitly stated

Any cruise, payment, refund, cancellation, safety obligation, licensing obligation, or dispute is strictly between the traveler and the operator.

3. Users

3.1 Travelers

Travelers may browse listings and contact operators using enquiry forms, email links, WhatsApp buttons, or external links. Travelers are responsible for confirming all critical details directly with the operator (including price, inclusions, fuel, duration, passenger limits, pickup location, safety equipment, licensing, insurance, and cancellation terms).

3.2 Operators

Operators (owners, managers, captains, or authorized representatives) may submit, claim, or update listings. Operators are responsible for ensuring that all submitted content is accurate, lawful, up to date, and that they have rights to publish it.

4. Listings, Tiers, and Presentation

BoatByDay may display listings with different levels of detail. Listings may be created from publicly available information, information submitted by operators, and/or operator-provided updates.

The position, size, appearance, label, badge, tier, order, or visibility of any listing does not constitute an endorsement, recommendation, guarantee, or verification of the operator or vessel.

We reserve the right to:

create, edit, correct, update, reclassify, restrict, suspend, hide, or remove listings
change how listings are presented (including layout, sorting, filters, labels, and featured placement)
request verification or supporting information for quality, fraud prevention, or safety reasons

5. Enquiries and Communications

5.1 Enquiry Forms

When a traveler submits an enquiry, the message is forwarded to the operator using the contact details associated with the listing. Delivery is not guaranteed.

5.2 WhatsApp / Messaging Buttons

Where available, WhatsApp or messaging buttons open third-party services. BoatByDay does not control those services and does not monitor private conversations on third-party apps.

5.3 No Emergency Use

BoatByDay is not an emergency service. Do not use the Platform for urgent safety matters.

6. External Links and “Instant Booking” Links

Some listings may include links to operator websites or third-party booking/management platforms. These are provided for convenience. BoatByDay is not responsible for external content, availability, payments, cancellations, chargebacks, or disputes arising off-platform.

7. Safety, Licensing, Insurance, and Compliance

BoatByDay does not guarantee that a vessel, skipper, or operator is appropriately licensed, insured, equipped, or compliant with any local rules. Travelers must independently confirm suitability and compliance directly with operators.

8. Prohibited Use

You must not:

submit false, misleading, or unauthorized content
impersonate any person or operator
harvest contact details or send spam
attempt to probe, scan, or compromise Platform security
use the Platform in a way that violates law or infringes rights

9. Operator Content, Permissions, and Marketing Use

By submitting or providing content, operators confirm they have the right to share it and grant BoatByDay a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, resize, crop, and format that content for the purposes of operating the Platform and promoting BoatByDay and the relevant listing.

Operators may request removal of specific content by emailing listings@boatbyday.com, subject to reasonable processing time and legal/operational constraints.

10. Moderation, Removal, and Complaints

We may remove, hide, or restrict listings or content if we believe it is inaccurate, misleading, unlawful, infringes rights, creates platform risk, or harms user trust.

To report a listing or request removal/correction, email listings@boatbyday.com with the listing link, the issue, and supporting information.

11. Disclaimers

The Platform is provided “as is” and “as available”. We do not warrant uninterrupted access or that enquiries will be delivered, read, or answered.

12. Limitation of Liability

To the maximum extent permitted by law, BoatByDay is not liable for any loss, injury, damage, delay, cancellation, dispute, or claim arising from:

any cruise, vessel condition, skipper/operator conduct, weather, route changes, or safety incident
communications or transactions between travelers and operators (on or off Platform)
external links, third-party apps, or third-party booking/payment systems
errors, omissions, or changes in listing information

13. Indemnity

You agree to indemnify and hold BoatByDay harmless from claims, losses, liabilities, costs, and expenses arising from your unlawful use of the Platform, your submitted content, or your breach of these terms.

14. Privacy Notice (Summary)

We process personal data to operate the Platform (e.g., forwarding enquiries, preventing abuse, troubleshooting delivery, and basic analytics).

Technical/usage data (e.g., IP address, device/browser info, timestamps, basic logs)
Operator submission/claim data (e.g., contact emails, verification evidence, listing content)

15. Cookies and Analytics

BoatByDay may use essential cookies and optional analytics cookies. Where required, cookie preferences are managed via a consent tool.

16. Paid Listings (Verified Tier)

Verified is a listing enhancement service (not a booking service). Fees are billed annually unless stated otherwise at checkout. Fees are non-refundable except where required by law. If a subscription ends or a payment fails, the listing may be downgraded.

17. Changes to These Terms

We may update these terms from time to time. Continued use after changes means you accept the updated terms.

18. Governing Law and Jurisdiction

These terms are governed by the laws of Greece and applicable European Union law. Disputes shall be subject to the courts of Greece.
